4. Sale and sharing of personal information for advertising
We do not sell personal information for money in the way that phrase is commonly understood. However, several US state privacy laws define "sale" and "sharing" broadly enough to include disclosures made in exchange for non-monetary benefit.
We participate in Shopify Audiences, through which we share information about your purchases and the email address associated with them so that we and other Shopify merchants can target advertising more effectively. We also allow advertising and analytics partners to collect identifiers, device information and browsing activity through cookies and pixels on our site.
These activities constitute a "sale" and "sharing for cross-context behavioural advertising" under the CCPA and comparable laws in other states. The categories involved are A (identifiers), B (commercial information), C (protected classifications, where inferred), D (internet activity), E (approximate geolocation) and G (inferences). The recipients are our advertising and analytics partners and, via Shopify Audiences, other participating Shopify merchants.
We do not sell or share the personal information of anyone we know to be under 16.
How to opt out. You may opt out at any time:
- Do Not Sell or Share My Personal Information
- Your Privacy Choices — submits an opt-out for this browser and, if you enter your email, for your account
- Enable the Global Privacy Control (GPC) signal in your browser or extension. We treat a valid GPC signal as an opt-out request for that browser and device, and for your account if you are signed in.
- Email hello@trendygolf.com with the subject line "Opt out of sale/sharing"
Opting out will not stop you seeing advertising; it makes the advertising you see less relevant. You can also limit interest-based advertising via optout.aboutads.info, optout.networkadvertising.org and youradchoices.com.
5. SMS Terms of Service
By providing your mobile phone number and opting into the TRENDYGOLF SMS programme, you agree to receive recurring automated promotional and personalised marketing text messages (for example cart reminders, product launches and exclusive offers) from TRENDYGOLF. Our SMS programme is operated through Klaviyo.
- Consent: Your consent to receive SMS is not a condition of purchase.
- Frequency: Message frequency varies.
- Charges: Standard message and data rates may apply, depending on your carrier.
- Opt-out: Reply STOP to any message at any time. You may receive a one-time confirmation text after opting out.
- Help: Reply HELP, or contact us at hello@trendygolf.com.
- Eligibility: You must be at least 13 years old to use our SMS services.
- Carriers: Participating carriers are not liable for delayed or undelivered messages.
6. Cookies and tracking
We use cookies, pixels, tags and similar technologies:
- Strictly necessary — log-in, cart, checkout, security and fraud prevention. These cannot be switched off.
- Performance and analytics — help us understand how the site is used.
- Advertising — used by us and our partners to understand your interests and show you relevant ads elsewhere.
- Functional — remember preferences such as region, currency, size and wishlist contents.
A current list of the cookies set by our Shopify storefront is maintained at shopify.com/legal/cookies.
You can manage cookies through your browser settings. Blocking cookies may prevent parts of the site from working, and does not by itself withdraw consent for other processing described here.
Do Not Track. There is no common industry standard for browser "Do Not Track" signals and we do not respond to them. We do honour the Global Privacy Control signal, as described in Section 4.
7. Data retention
We retain personal information for the periods in Section 1. Where those do not apply, we keep information for as long as needed for the purpose it was collected, plus any period required to meet legal, tax, accounting or reporting obligations, resolve disputes or enforce our agreements. Information no longer needed is deleted or de-identified.
8. Your privacy rights
Residents of states with comprehensive privacy laws — currently including California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia — have the following rights, subject to the limits in their state's law:
- Know and access — confirm whether we process your information and get a copy, with the categories collected, sources, purposes and categories of recipients
- Delete — request deletion of information we collected from you
- Correct — request correction of inaccurate information
- Portability — receive a copy in a portable, machine-readable format
- Opt out of sale, sharing and targeted advertising — see Section 4
- Opt out of profiling with legal or similarly significant effects. We do not carry out this kind of profiling.
- Limit use of sensitive personal information — we use it only for permitted purposes, so this right does not currently apply
- Non-discrimination — we will not deny you goods or services, charge different prices or provide lesser service because you exercised a privacy right. Differences in TGCC Rewards benefits reflect your membership tier and purchase history, not your privacy choices.
How to make a request: use US Privacy Requests or email hello@trendygolf.com. We acknowledge within 10 business days and respond within 45 days, extendable once by a further 45 days where reasonably necessary — we will tell you if we need the extension.
Verification. We will verify your identity before acting on an access, deletion, correction or portability request. For account holders this normally means signing in; otherwise we will ask for information matching what we already hold, such as the email address and order number from a recent purchase. We will not create accounts or collect new categories of information to verify you.
Authorised agents. You may use an authorised agent. We will ask for written permission signed by you and may still ask you to verify your identity directly.
Appeals. If we decline a request you may appeal by replying to our decision or emailing hello@trendygolf.com with "Privacy appeal" in the subject line. We respond in writing within 45 days (60 days in Colorado). If we deny the appeal we will give you a way to contact your state Attorney General.
California "Shine the Light". California residents may request once per calendar year a list of personal information we disclosed to third parties for their own direct marketing purposes.
9. Children's privacy
Our site is intended for adults. We do not knowingly collect personal information from anyone under 13, and we do not sell or share the personal information of anyone under 16. We sell youth-sized apparel, but those purchases are made by adults; we do not collect information directly from children. If you believe a child under 13 has provided us with personal information, email hello@trendygolf.com and we will delete it.
10. Data security
We use administrative, technical and physical safeguards designed to protect personal information, including encryption in transit, access controls and PCI DSS compliant payment processors. No system is completely secure and we cannot guarantee absolute security.
11. Visitors from outside the United States
This site is operated from the United States. Personal information is stored and processed in the United States and other countries where our service providers operate, including Canada. Privacy laws in those countries may differ from those where you live.
Visitors from other regions can exercise applicable rights via: GDPR Privacy Requests (EEA/UK) · Canadian Privacy Rights (PIPEDA and Quebec Law 25) · Australia & New Zealand · Personal Data Requests (all other regions).
12. Changes to this policy
We may update this policy to reflect changes in our practices or for legal, operational or regulatory reasons. We update the "Last Updated" date above and review this policy at least once every 12 months. Where changes are material we will give notice on the site.
13. Complaints
Contact us using the details in the Contact section. If you are not satisfied with our response you may contact your state Attorney General. California residents may also contact the California Privacy Protection Agency at cppa.ca.gov.
